Welcome to Bagel Off! The terms "we", "us" and "our" refer to Bagel Off. Bagel Off operates this store and website to provide you with fresh, handrolled, baked-to-order bagels delivered within Wellington, New Zealand (the "Services").

Bagel Off is powered by Shopify, which enables us to provide the Services to you.

By visiting or placing an order through our website, you agree to be bound by these Terms of Service. Please read them carefully. If you do not agree, please do not use our Services.

SECTION 1 — ACCESS

By using our Services, you confirm that you are at least 18 years of age, or that you have the consent of a parent or guardian. You are responsible for ensuring that all information you provide at checkout — including your name, address, email, and payment details — is accurate and complete.

SECTION 2 — OUR PRODUCTS

Bagel Off sells fresh, handrolled, sourdough bagels baked to order in a home kitchen in Johnsonville, Wellington. All bagels are made in small batches and may vary slightly in appearance from photos shown on the website. This is a sign of handmade quality, not a defect.

Available flavours are listed on the website and are subject to change.

We reserve the right to discontinue any flavour or product at any time.

SECTION 3 — ORDERS AND CUTOFF

All orders are baked fresh to order on a weekly schedule:

  • Order cutoff: Sunday 12pm
  • Bake days: Monday and Tuesday
  • Pickup: Monday from 3pm, Johnsonville, Wellington
  • Delivery: Tuesday, Wellington area only

Orders placed after the Sunday 12pm cutoff will be held for the following week's bake. You will receive an email confirmation once your order is accepted and again when your order is ready.

Bagel Off reserves the right to decline any order at our discretion. Your order is not confirmed until you receive a confirmation email from us.

SECTION 4 — PRICES AND PAYMENT

All prices are listed in New Zealand Dollars (NZD) and include GST. Delivery fees are charged at a flat rate and displayed at checkout before payment.

Prices are subject to change without notice. The price charged will always be the price shown at the time your order is placed.

Promotional offers, including the Soft Launch Deal, are subject to availability and may be withdrawn at any time.

SECTION 5 — DELIVERY

Bagel Off offers local delivery within the Wellington region every Tuesday. A flat delivery fee applies and is shown at checkout.

Delivery is available to selected Wellington suburbs. If your address is outside our delivery zone, please contact us before ordering.

We are not liable for delays caused by incorrect address information provided at checkout. Once your order has been handed to you or left at your door, responsibility passes to you.

If you are not home at the time of delivery, we will attempt to contact you via the phone number provided at checkout.

SECTION 6 — PICKUP

Pickup is available from our Johnsonville, Wellington location every Monday from 3pm. Your exact pickup address will be confirmed in your order confirmation email.

If you are unable to collect your order during the pickup window, please contact us as soon as possible. We will do our best to arrange an alternative but cannot guarantee availability outside scheduled times.

SECTION 7 — CANCELLATIONS

Orders may be cancelled before the Sunday 12pm cutoff by contacting us via WhatsApp at +642904333826.

Once the Sunday 12pm cutoff has passed, we are unable to cancel your order as baking preparation has already begun. No refunds will be issued for cancellations requested after the cutoff.

SECTION 8 — REFUNDS AND REPLACEMENTS

Because our bagels are a perishable, made-to-order food product, we do not accept returns or offer refunds for change of mind.

If you receive the wrong flavour or your order arrives damaged, contact us within 24 hours via WhatsApp at +642904333826 or through our Contact page. Please include a photo of the issue. We will arrange a replacement on the next bake day at no cost to you.

We do not offer cash refunds for wrong or damaged orders — but we will always make it right with a replacement.

SECTION 9 — ALLERGEN DISCLAIMER

Bagel Off operates from a registered home kitchen in Johnsonville, Wellington. Our bagels are made with ingredients including gluten (wheat flour), sesame, dairy, and eggs.

We are not a certified allergen-free facility. Cross-contamination with allergens including gluten, sesame, dairy, and eggs may occur during preparation. If you have a severe food allergy, please contact us before placing an order so we can advise you appropriately.

Bagel Off accepts no liability for allergic reactions arising from undisclosed allergen sensitivities.

SECTION 10 — INTELLECTUAL PROPERTY

All content on this website — including the Bagel Off name, logo, product descriptions, photography, and branding — is owned by Bagel Off and may not be reproduced, copied, or used without our prior written consent.

SECTION 11 — LIMITATION OF LIABILITY

To the fullest extent permitted by New Zealand law, Bagel Off shall not be liable for any indirect, incidental, or consequential damages arising from the use of our products or Services. Our total liability to you shall not exceed the amount paid for the order in question.

Nothing in these Terms limits your rights under the New Zealand Consumer Guarantees Act 1993 or the Fair Trading Act 1986.

SECTION 12 — PRIVACY

All personal information collected through our website is used solely to process and fulfil your order and to communicate with you about your order. We do not sell or share your personal information with third parties except as required to process payments and deliver orders.

Our website is powered by Shopify. Shopify's Privacy Policy also applies to information collected through our store.

SECTION 13 — GOVERNING LAW

These Terms of Service are governed by the laws of New Zealand. Any disputes arising from these Terms shall be subject to the jurisdiction of the New Zealand courts.

SECTION 14 — CHANGES TO THESE TERMS

We reserve the right to update these Terms at any time. Changes will be posted on this page with an updated date. Continued use of our Services after changes are posted constitutes your acceptance of the updated Terms.
